This Service exists solely for comedy and entertainment purposes. It is the digital equivalent of a joke between friends. Any resemblance to actual analysis, assessment, or evaluation is purely coincidental and unintended.

The Service allows you to upload photographs for analysis. By uploading any photograph, you represent and warrant that:

• You are the person depicted in the photograph, OR
• You have obtained the explicit, informed consent of every identifiable person in the photograph before uploading it to this Service
• You have the legal right to submit the photograph for this purpose
• The photograph does not violate any applicable law, third-party right, or platform policy

Uploaded photographs are transmitted to Google Gemini (operated by Google LLC) solely for the purpose of generating a response. We do not store, retain, or save uploaded photographs at any point. Images are discarded immediately after the AI returns a result.

Because images are processed by Google Gemini, all uploads must comply with Google's Generative AI Prohibited Use Policy. Submitting content that violates Google's policies — including hateful, violent, or sexually explicit material — is strictly prohibited.

You agree not to use the Service to:

• Harass, bully, intimidate, or harm any individual
• Share results with the intent to demean, humiliate, or out any person regarding their sexual orientation or gender identity
• Upload any photograph or image that depicts a minor (a person under 18 years of age)
• Upload, transmit, or share Child Sexual Abuse Material (child sexual abuse imagery) or any content that sexually exploits or depicts a minor in any form — this is a criminal offense and will be reported to law enforcement and relevant authorities
• Upload non-consensual intimate images, or any photograph of an identifiable person taken or shared without their explicit, informed consent
• Upload any content that violates Google's Generative AI Prohibited Use Policy or Google Gemini's usage guidelines, including hateful, violent, or sexually explicit material
• Upload or submit any content that is illegal under applicable law
• Attempt to reverse-engineer, scrape, or abuse the Service
• Use the Service for any unlawful purpose
• Circumvent usage limits, credit systems, or access controls

We reserve the right to terminate access for any user found violating these prohibitions.

Certain features of the Service require the purchase of credits (also referred to as "scans"). All purchases are processed by a third-party payment provider. By making a purchase, you agree to that provider's terms and conditions in addition to these Terms.

Prices are displayed in USD and may be subject to local taxes depending on your jurisdiction. We reserve the right to change pricing at any time with reasonable notice.

The Service uses the following third-party providers:

• Google — authentication via Google Sign-In
• Google Gemini (Google LLC) — AI image and text processing
• Payment processor — purchase handling

Your use of these integrations is subject to the respective third parties' terms of service and privacy policies. We are not responsible for the practices of these third parties.

All content, design, code, and branding associated with howgayismyfriend.com is owned by or licensed to us. You may not copy, reproduce, or distribute any part of the Service without our prior written consent.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, INCLUDING ANY HARM CAUSED BY MISUSE OF RESULTS OR UNAUTHORIZED PHOTO UPLOADS BY USERS.

Our total liability to you for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the 30 days preceding the claim.

These Terms are governed by the laws of the Republic of Kazakhstan. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Kazakhstan, unless otherwise required by mandatory consumer protection laws in your jurisdiction.

We may update these Terms at any time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms. We will update the "Last updated" date at the top of this page when changes are made.
